(hereafter referred to as “ANSWER AI”, “we”, “us”, or “our”) These terms and conditions govern your use of the ANSWER AI website and mobile application (the “App” or “Service”). By accessing or using the App, you agree to be bound by these terms and conditions. If you do not agree to these terms and conditions, you may not use the App. The Site and Services are offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). Your use of the Site and Services constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference. We reserve the right to update or modify these Terms at any time without prior notice to you, and your continued use of the Site following ANSWER AI’s posting of any changes will constitute your acceptance of such changes or modifications. Privacy Your use of the Site and Services are subject to ANSWER AI’s Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices. ANSWER AI does not knowingly collect, either online or offline, personal information from persons under the age of 13.

“User” refers to any individual or entity that accesses or uses the App.

License: ANSWER AI grants you a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal or commercial purposes, subject to these terms and conditions.

Prohibited Use: You may not use the App for any illegal or unauthorized purpose, or in any way that violates these terms and conditions. You may not modify, reverse engineer, decompile, or disassemble the App or its underlying technology.

User Content: You are responsible for any content you create or edit using the App. You retain ownership of your content, but by submitting or uploading it to the App, you grant ANSWER AI a non-exclusive, worldwide, royalty-free, sublicensable license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any manner such content in all formats and distribution channels now known or hereafter devised (including in connection with the App and ANSWER AI’s business and on third-party sites and services), without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.

Accuracy of Information: You represent and warrant that all information you provide to ANSWER AI is accurate, complete, and current. You are responsible for keeping your account information up to date.

Intellectual Property

Ownership: ANSWER AI and its content, including but not limited to text, graphics, logos, icons, images, audio, and software, are the property of ANSWER AI or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Restrictions: You may not copy, modify, distribute, or create derivative works based on ANSWER AI or its content without the express written permission of ANSWER AI. You may not use any metatags or other hidden text utilizing ANSWER AI’s name or trademarks without the express written consent of ANSWER AI.

Use of AI Technologies:

The content generated by our platform may utilize AI technologies, including OpenAI’s GPT-3 technology and other LLM models. While we strive to ensure that the generated content is as accurate as possible, we cannot guarantee the accuracy or completeness of the information provided. The information generated by these technologies is based on the data available to them and the algorithms used to analyze and interpret that data, and therefore may not be entirely accurate or appropriate for your specific needs. Users should exercise caution when relying on the information provided by our platform.

Limitation of Liability:

We will not be liable for any damages, losses, or expenses arising from the use of our platform or the content generated by it. You acknowledge that you are using our platform and the content generated by it at your own risk, and that we do not make any warranties, express or implied, regarding the accuracy, reliability, or completeness of the content generated by our platform.

No Unlawful or Prohibited Use/Intellectual Property

You are granted a non-exclusive, non-transferable, revocable license to access and use the Site and Services strictly in accordance with these terms of use. As a condition of your use of the Site, you warrant to ANSWER AI that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. All content included as part of the Site and Services, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site or in the Application, is the property of ANSWER AI, its suppliers or third-parties and protected by trademark, copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all trademark, copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto, including without limitation altering any proprietary rights or attribution notices in any such content. Access to the Site and Services does not authorize anyone to use any of ANSWER AI’s names, logos or marks, including without limitation the ANSWER AI trademark or logo, or any other intellectual property in any manner. The content on the Site may be used only as an information resource, and ANSWER AI content is not for resale. You will use protected content solely for your personal, non-commercial use, and will make no other use of the content without the express written permission of ANSWER AI and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We utilized the Terms of Service Generator to craft our own set of policies. We do not grant you any licenses, express or implied, to the intellectual property of ANSWER AI or our licensors except as expressly authorized by these Terms. Any other use, including the reproduction, modification, distribution, transmission, republication, display, or performance, of the content on the Site is strictly prohibited.

Further, in your use of the Site and Services, you may not: modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site or the Application; use web crawlers, web robots, web scutters, ants, automatic indexers, bots, worms, and other such devices in connection with the Site; provided, however, that general purpose Internet search engines and non-commercial public archives that use tools to gather information for the sole purpose of displaying hyperlinks to the Site are granted a limited exception from the foregoing exclusion, provided that they do so from a stable IP address or range of IP addresses using an easily-identifiable agent; use the Site in any manner that could damage, disable, overburden, or impair the Site or interfere with any other party’s use of the Site; obtain or attempt to obtain any content through any means not intentionally made available or provided for through the Site; remove, modify, disable, block, obscure or otherwise impair any advertising in connection with the Site; collect personally identifiable information of other users or visitors; harvest information about users for the purpose of sending, or to facilitate or encourage the sending of, unsolicited bulk or other communications; or post or transmit any worms, viruses, Trojans, or other harmful, disruptive, or destructive files, code, or programs to the Site.

ANSWER AI will fully cooperate with any law enforcement authorities or court order requesting or directing ANSWER AI to disclose the identity of anyone violating these Terms. In its sole discretion, in addition to any other rights or remedies available to and without any liability whatsoever, ANSWER AI may at any time and without notice may terminate or restrict your access to any component of the Site.

Payment and Refund Policy

Payment: ANSWER AI may charge a fee for certain features or services provided by the App. You agree to pay all fees and charges incurred in connection with your use of the App, including any applicable taxes.

Refunds: ANSWER AI does not offer refunds for any fees or charges incurred in connection with your use of the App.

No Endorsement

ANSWER AI does not endorse any of the courses about which information is provided via the Site or Services. You are responsible for determining the identity and suitability of others whom you contact via the Site or Services. We will not be responsible for any damage or harm resulting from your interactions with any online course providers. Your dealings with online course providers and any other terms, conditions, representations or warranties associated with such dealings, are between you and such online course providers exclusively and do not involve ANSWER AI. You should make whatever investigation or other resources that you deem necessary or appropriate before signing up for any online courses. By using the Site or Services, you agree that any legal remedy or liability that you seek to obtain for actions or omissions of any online course providers or other third parties will be limited to a claim against the particular online course providers or other third parties who caused you harm, and you agree not to attempt to impose liability on, or seek any legal remedy from ANSWER AI with respect to such actions or omissions and hereby release ANSWER AI from any and all liability for or relating to any interactions or dealings with online course providers.

Disclaimers

No Warranty: ANSWER AI is provided on an “as is” basis without warranties of any kind, either express or implied. ANSWER AI does not guarantee that the App will be error-free or uninterrupted.

International Users

The Site and Services are controlled, operated and administered by ANSWER AI from our offices within the Pakistan If you access the Site or Services from a location outside the Pakistan, you are responsible for compliance with all local laws. You agree that you will not use the ANSWER AI content accessed through the Site or Services in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

Delays

The Site or Services may be subject to limitations, delays and other problems inherent in the use of the Internet and electronic communications. ANSWER AI is not responsible for any delays, failures or other damage resulting from such problems.

Limitation of Liability

Indemnification: You agree to indemnify and hold ANSWER AI and its officers, directors, employees, agents, and representatives harmless from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the App or your breach of these terms and conditions.

Limitation of Liability: In no event shall ANSWER AI be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App, whether based on contract, tort, strict liability, or any other legal theory, even if ANSWER AI has been advised of the possibility of such damages.

Termination

Termination: ANSWER AI may terminate your access to the App at any time, without cause or notice. You may also terminate your account at any time by contacting ANSWER AI’s customer support.

Effect of Termination: Upon termination, your license to use the App will immediately terminate, and you must cease all use of the App. All provisions of these terms and conditions that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law

Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of the state or country where ANSWER AI is headquartered, without giving effect to any principles of conflicts of law.

Dispute Resolution: Any disputes arising out of or relating to these terms and conditions or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Changes to the Terms and Conditions

Changes: ANSWER AI may update these terms and conditions at any time, and your continued use of the App following any changes constitutes your acceptance of the changes.

Notification: ANSWER AI will notify you of any material changes to these terms and conditions by posting a notice on the App or by sending you an email to the email address you provided during registration.

Miscellaneous

Entire Agreement: These terms and conditions constitute the entire agreement between you and ANSWER AI regarding your use of the App. Waiver: The failure of ANSWER AI to enforce any right or provision of these terms and conditions shall not constitute a waiver of such right or provision. Severability: If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Assignment: You may not assign or transfer these terms and conditions, by operation of law or otherwise, without ANSWER AI’s prior written consent. Any attempt by you to assign or transfer these terms and conditions without such consent will be null and void. ANSWER AI may assign or transfer these terms and conditions, in whole or in part, without restriction.

User Content

User Content: The App may allow you to submit or upload content, such as text, images, and videos (“User Content”). You retain all rights in, and are solely responsible for, the User Content you submit or upload.

License: By submitting or uploading User Content, you grant ANSWER AI a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any manner such User Content in all formats and distribution channels now known or hereafter devised (including in connection with the App and ANSWER AI’s business and on third-party sites and services), without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.

Representations and Warranties: You represent and warrant that: (i) you either are the sole and exclusive owner of all User Content or you have all rights, licenses, consents, and releases that are necessary to grant to ANSWER AI the rights in such User Content, as contemplated under these terms and conditions; and (ii) neither the User Content, nor your submission, uploading, publishing, or otherwise making available of such User Content, nor ANSWER AI’s use of the User Content as permitted herein will infringe, misappropriate or violate a third party’s patent, copyright, trademark, trade secret, moral rights or other proprietary or intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.

Feedback

Feedback: If you provide ANSWER AI with any feedback or suggestions regarding the App, you grant ANSWER AI a non-exclusive, worldwide, perpetual, irrevocable, fully-paid, royalty-free license to use, reproduce, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any manner such feedback and suggestions without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.

No Obligation: ANSWER AI shall have no obligation to you with respect to any feedback or suggestions you provide.

Disclaimer of Warranties

Disclaimer of Warranties: The App is provided “as is” and “as available” without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

No Warranty: ANSWER AI does not warrant that the App will meet your requirements or be available on an uninterrupted, secure, or error-free basis. ANSWER AI does not warrant the accuracy, completeness, or usefulness of any information provided through the App.

Changes are periodically added to the information herein. ANSWER AI and/or its suppliers may make improvements and/or changes in the site at any time. ANSWER AI and/or its suppliers make no representations about the suitability, reliability, availability, timeliness, and accuracy of the information, software, products, services and related graphics contained on the site for any purpose. To the maximum extent permitted by applicable law, all such information, software, products, services and related graphics are provided “as is” without warranty or condition of any kind. ANSWER AI and/or its suppliers hereby disclaim all warranties and conditions with regard to this information, software, products, services and related graphics, including all implied warranties or conditions of merchantability, fitness for a particular purpose, title and non-infringement. YOU EXPRESSLY UNDERSTAND AND AGREE THAT ANSWER AI WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, COMPENSATORY, CONSEQUENTIAL OR EXEMPLARY DAMAGES (EVEN IF ANSWER AI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) (COLLECTIVELY, “DAMAGES”), RESULTING FROM: (A) THE USE OR INABILITY TO USE THE SERVICE; (B) THE COST OF ANY GOODS AND/OR SERVICES PURCHASED OR OBTAINED AS A RESULT OF THE USE OF THE SERVICE; (C) DISCLOSURE OF, UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR INFORMATION OR CONTENT; (D) CONTENT YOU SUBMIT, RECEIVE, ACCESS, TRANSMIT OR OTHERWISE CONVEY THROUGH THE SERVICE; (E) STATEMENTS OR CONDUCT OF ANY ONLINE COURSE PROVIDERS OR OTHER THIRD PARTY THROUGH THE SERVICE; (F) ANY OTHER MATTER RELATING TO THE SERVICE; (G) ANY BREACH OF THIS AGREEMENT BY ANSWER AI OR THE FAILURE OF ANSWER AI TO PROVIDE THE SERVICE UNDER THIS AGREEMENT OR (H) ANY OTHER DEALINGS OR INTERACTIONS YOU HAVE WITH ANY ONLINE COURSE PROVIDERS (OR ANY OF THEIR REPRESENTATIVES OR AGENTS). THESE LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW. In some jurisdictions, limitations of liability are not permitted. In such jurisdictions, some of the foregoing limitations may not apply to You.
